Many laws have been tried of passing in Malaysia, but never did to diminish the pay gap between men and women in Malaysia. Still, the problem persists where men are paid more than women and to mention the facts, there is close to 21% difference in the salary between men and women.
The Malaysian Government must focus on many laws that are aimed to end the discrimination on basis of sex and other factors. The laws must be passed in order to bridge the gap to protect women’s rights because the pay gap is increasing every six months.
When it comes to the data, women are paid less in every department irrespective of them being a manager or a developer in an IT firm or an unskilled worker. In some positions, women are not even hired by women employees’ because they do feel that men work harder than women.
Even though we have come a long way when it comes to equality, enough laws are not passed to end the pay scale gap. In a statistics, women are paid lesser than men of equal age when they are of ages 25 to 34. Even though it is only a few years that Malaysia planned for high-income status, the disparity between the payments does not look to fade any time soon.
Why do men receive more pay than women?
Here are a few reasons that could be a factor for women being paid less.
Marriage and motherhood
When a woman gets married, they give birth to children for nine months. After that, the maternity leave for women in Malaysia is 60 days. So, companies understand that there needs to be a replacement for the time period and may lose their productivity if no one else joins during the period.
Are men better than women in education?
Malaysian women are more educated than men who are derived from the pass percentage statistics of higher schools and colleges. There is close to ten percent difference in the pass percentage. Women also tend to score more marks than men in Malaysia.
Women hold better degrees than men in many fields like computer science, IT, economics and much more which answers the question that women are better in education than men.
The Equal Pay Act
The Equal Pay Act deals with employers, and it states that men and women should be given the same wage without any disparity and it is illegal if women are paid less when they belong to the same sector and work for the same conditions as men.
Even though the job titles may be the same, job duties would be different. That’s why Malaysians came up with a law to make payment for employees’ based on their responsibilities at work and not their roles in the organization.
The law also was constructed to create a pay scale based on the physical and mental exertion to perform in the job. Both women and men would be paid the same wage irrespective of whom plays the task. Even working conditions were taken into consideration to create an equal pay among both the sexes like physical surrounding and hazards at work.
Similar salary discrepancy problems in other countries
Many countries have not created a fair system when it comes to Payscale. Here is what happened in the 9th Circuit Court in the United States of America.
Other court rules
The salary history is not the reason for pay differences under the UPA. This judgment was given by the 9th Circuit Court in the USA which also set some laws to avoid discrepancies in the payment system of the country by categorizing the following:
- A seniority system
- A merit system
- By measuring the quantity and quality of work
- Any factor other than sex
The employers placed in an essential fact that they have always used the salary history to determine their new salary and believed that this would fall under the category ‘any factor other than sex.’ The court did not accept the claim and also stated that the salary history does not have any impact on the gender pay discrimination.
To avoid salary discrepancies, many more laws are to be created and allow women to live with dignity. When it comes to a system in a democratic country, regulations must be stringent that everyone in the country is given the same equal space in the society.
